Terms of Use

1. Who we are and acceptance of these terms

This website, meridian-architectural.com (the "Site"), is operated by Meridian Studio (Pty) Ltd ("Meridian", "we", "us"), an architectural production studio based in Still Bay, Western Cape, South Africa.

By accessing or using the Site you agree to these Terms of Use. If you do not agree, do not use the Site. These terms govern use of the Site only. Engaged project work between Meridian and a client is governed by the written engagement terms agreed for that work, and those terms prevail over these Terms of Use to the extent of any conflict.

2. Purpose of the Site

The Site describes Meridian's architectural production services, including Design / Design Support, Construction Documentation, 3D Rendering & Visualisation, and CAD Drafting, and allows prospective clients to contact us. Content on the Site, including indicative pricing and turnaround times, is provided for general information and does not constitute a binding offer. All engagements are confirmed in writing with an agreed scope, fee, and timeline.

3. Lawful use

You may use the Site only for lawful purposes. You may not use the Site in any way that breaches applicable law, infringes the rights of any person, or interferes with the operation or security of the Site.

4. Intellectual property

All content on the Site, including text, graphics, logos, photographs, renderings, drawings, sample work, page layouts, and underlying code, is owned by or licensed to Meridian and is protected by copyright and other intellectual property laws. Sample work shown on the Site is displayed with the necessary permissions and remains subject to the rights of the relevant project owners.

You may view, download, and print content from the Site for your own internal evaluation of our services. You may not otherwise reproduce, distribute, modify, or create derivative works from Site content without our prior written consent. The Meridian Studio name and logo may not be used without our prior written consent.

5. Acceptable use

You may not: attempt to gain unauthorised access to the Site, its server, or any connected database; introduce malware or other harmful code; scrape, harvest, or bulk-download Site content or contact details; misrepresent your identity when contacting us; or use the Site to send unsolicited marketing.

6. Contact form and communications

When you contact us through the Site you warrant that the information you provide is accurate and that you are authorised to provide it. Our collection and use of that information is described in our Privacy Policy. Submitting an enquiry does not create a client relationship or any obligation on Meridian to respond to or accept a brief.

7. No professional advice through the Site

Content on the Site is general information about our services. It is not architectural, engineering, legal, or other professional advice, and it is not a substitute for advice on any specific project. Nothing on the Site creates a professional appointment or duty of care to any visitor.

8. Third-party links and services

The Site may link to third-party websites or services, including messaging and payment platforms. Those sites are not under our control and we are not responsible for their content or practices. Use of any third-party service is at your own risk and subject to that provider's terms.

9. Availability and changes

We may change, suspend, or discontinue any part of the Site at any time without notice. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We may update these Terms of Use from time to time; the current version is always available on the Site and applies from the moment it is published.

10. Disclaimer

The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. Indicative pricing, turnaround times, and service descriptions may change without notice.

11. Limitation of liability

To the maximum extent permitted by law, Meridian will not be liable for any indirect, incidental, special, or consequential loss, or for loss of profits, business, or data, arising out of or in connection with your use of the Site. Our total liability arising from use of the Site is limited to R1,000 or the equivalent amount. Liability arising from engaged project work is governed by the applicable engagement terms.

12. Indemnity

You indemnify Meridian against claims, losses, and expenses arising from your breach of these terms or your unlawful use of the Site.

13. Privacy

Our collection and use of personal information through the Site is described in our Privacy Policy and, where applicable, our PAIA Manual, both available on the Site. By using the Site you acknowledge that processing takes place as described there.

14. Governing law and disputes

These Terms of Use are governed by the laws of the Republic of South Africa. The courts of South Africa have jurisdiction over any dispute arising from use of the Site, without prejudice to any mandatory consumer rights you may have in your own jurisdiction.

15. General

If any provision of these terms is held unenforceable, the remainder continues in force. A failure to enforce any provision is not a waiver. These terms, together with the Privacy Policy, are the entire agreement between you and Meridian regarding use of the Site.
